Terms and Conditions – Pois Ibiza
Pois Ibiza, located at Calle de la Cruz, 7, Ibiza, Spain, reserves the right to modify prices at any time. In the event of an incorrect and/or significantly derisory price display, for any reason (such as computer error, manual mistake, technical glitch, etc.), the order will be canceled, even if initially validated.
DELIVERY METHODS AND TIMES
Pois Ibiza will dispatch the selected and ordered products to customers via couriers and/or shippers.
Delivery times vary depending on the customer’s location, ranging from a minimum of 24 hours to a maximum of 7 days from the actual order confirmation date. Confirmation occurs upon accepted payment via credit card, PayPal, or upon receipt of a bank transfer.
Upon delivery, the Customer must ensure that:
• the number of packages delivered matches what is indicated on the invoice;
• the packaging is intact, undamaged, dry, and unaltered.
Any external damages or discrepancies in the number of packages or indications must be immediately reported to the delivering courier, by stating “withdrawal with reserve” on the appropriate accompanying document. This must be confirmed within 8 days by registered letter with return receipt to the courier, whose address is specified on the accompanying document. In the case of damaged packaging, specify “Accepted subject to inspection” because the package is damaged”. Additionally, an anomaly report must be opened at Pois Ibiza by sending an email with the description: “Damaged Package Shipment Order No.xxxxxx”, to info@poisibiza.com. Once the courier’s document is signed, no claims regarding the external characteristics of the delivered goods can be made. Even in the presence of intact packaging, the goods must be checked within eight days of receipt. Any damages or hidden anomalies must be reported in writing by registered letter with return receipt to Pois Ibiza, Calle de la Cruz, 7, Ibiza, Spain, with the description: “Hidden Damage Shipment Order No.xxxxxx”. Reports beyond the aforementioned terms will not be considered. The Customer assumes full responsibility for any declarations made.
If, within 24 hours of delivery, which is considered essential, the Customer finds non-conformity and/or discrepancies compared to the order, Pois Ibiza will reimburse the customer for the expenses incurred for returning the product for replacement. However, if the disputed order is returned without meeting the conditions of receipt (i.e., not in perfect condition, unused, with the original packaging and without any defects), Pois Ibiza will consider the purchase finalized by the customer, who will be responsible for collecting the goods from Pois Ibiza’s logistics facility.
Pois Ibiza reserves the right to charge the customer for any expenses incurred for product verification and shipment, if the product is found intact and functional, contrary to the customer’s claims. Regarding the costs of shipment, these are automatically calculated by the system based on the type and quantity of the product intended to be purchased. In this case, the item “Shipping Costs” in the shopping cart will be “x”. Note that shipping costs relate only to domestic shipments. The goods always travel at the customer’s risk, even if the shipment is agreed to be FOB
NOTICES: If the delivered goods are accepted without any complaints or reservations by the courier, it will not be possible to claim any shortages or damages due to transportation at a later time.
RIGHT OF WITHDRAWAL
Purchases made on our website, like all distance purchases via telephone or correspondence, are protected by Legislative Decree no. 185 of May 22, 1999, which provides the consumer with the right of withdrawal. The consumer can exercise the right of withdrawal within a period of 10 working days from the receipt of the goods. This right consists of the possibility for the consumer to return the purchased item to the supplier without any penalty and without specifying the reason, and the subsequent refund of the purchase price.
Exclusions:
The right of withdrawal applies to individuals acting for purposes not related to their professional activity. Therefore, purchases made by retailers and companies are excluded from the right of withdrawal.
Exercise of the right of withdrawal:
The right of withdrawal is exercised by sending, within the aforementioned period of 10 working days from the receipt of the goods, a written communication by registered letter with acknowledgment of receipt addressed to: Pois Ibiza, Calle de la Cruz, 7, Ibiza, Spain. The communication can also be sent, within the same period, by telegram or fax, provided it is confirmed by registered letter with acknowledgment of receipt within 48 hours. This communication must contain the codes of the products intended to be returned, as well as indications regarding the refund method for the expenses incurred (money order, bank transfer, etc.) and any bank details. The products subject to reconsideration must be returned by the consumer, in substantially intact condition, to the same address used for the registered letter. Once the goods are received and their integrity verified, Pois Ibiza will credit the customer with the cost of the returned products as soon as possible, withholding, if necessary, the amount of the shipping costs, which will remain the responsibility of the customer. If the returned goods, at the unquestionable discretion of Pois Ibiza, are not in substantially intact condition, no refund will be made.
Warranty
To benefit from Warranty Assistance, the Customer must retain the receipt or invoice verifying the purchase.
By accepting the purchase contract, the Customer acknowledges the assistance procedures in force at the time of resorting to Warranty Assistance.
To minimize damage to the original packaging, we recommend, when possible, placing it in a second box; in all cases, avoid applying labels or adhesive tapes directly on the original product packaging.
The replacement or eventual repair times of the product depend exclusively on the manufacturer’s policies. No damages can be claimed from Pois Ibiza for any delays in carrying out repairs or replacements performed by the Assistance Centers chosen by the Customer.
Damaged Product upon Delivery
In the event of a damaged product upon delivery, Pois Ibiza will directly arrange for replacement or eventual repair.
The notification of a damaged product upon delivery must be made immediately and in any case within 48 working hours of delivery to the address info@poisibiza.com.
Within 10 working days of receiving the goods, the Customer must send the item to the address that will be communicated by our customer service.
If, for any reason, Pois Ibiza is unable to provide its Customer with a warranted product (restored or replaced), Pois Ibiza may, at its discretion, proceed with either a full refund of the amount paid or a replacement with a product of equal or superior characteristics.
The replacement or eventual repair times depend exclusively on the manufacturer’s policies.
Please note, “damaged product upon delivery” does not refer to a product that has been damaged due to transportation to the Customer’s home.
Jurisdiction Clause
The sales contract between the Customer and Pois Ibiza is deemed concluded in Spain and governed by Spanish Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, The territorial jurisdiction shall be exclusively that of the Court of Ibiza.
Advertising Rules Clause
All product listings displayed on this website are not intended as advertisements.
All content must be understood and is solely informative in nature, aimed exclusively at informing customers or potential customers in the pre-purchase phase of products sold through this website.
No content on the website pages should be construed as advertising material aimed at influencing a purchase decision in any way.
Withdrawal
The right of withdrawal is governed by the Spanish legislation, specifically by Law 3/2014 of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. This law transposes Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights
The Customer (i.e., an individual who purchases goods for purposes not related to their professional activity, or does not make the purchase by indicating a VAT number in the order form) has the right to withdraw from the purchase contract for any reason.
To exercise this right, the Customer must send a communication to Pois Ibiza within 14 days from the date of receiving the goods. The withdrawal communication must be sent to info@poisibiza.com or by registered letter with return receipt to: Pois Ibiza – Calle de la Cruz, 7, Ibiza, Spain.
The communication can also be sent in advance via email to the address indicated on the contact page, provided it is confirmed by registered letter with return receipt within 48 hours.
Pois Ibiza will refund the amount paid by crediting it back using the same payment method used for the purchase, PayPal, or bank transfer, within 14 days from receiving the withdrawal communication. It is the Customer’s responsibility to provide bank details (IBAN) for the refund. In any case, amounts will not be refunded for additional costs due to a delivery method other than the least expensive type offered by Pois Ibiza.
The right of withdrawal lapses or is reduced if the essential condition of integrity of the product (packaging and/or its contents) is lacking, in cases where Pois Ibiza verifies:
- partial use of the product and any consumables;
- absence of the external packaging and/or original internal packaging;
- damage to the product due to causes other than its transportation;
- absence of integral elements of the product (accessories, parts, etc.).
In the above cases, Pois Ibiza will return the purchased item to the sender, charging the same for shipping costs.
Attention: Customers who purchase with a VAT number cannot exercise the right of withdrawal.
Withdrawal Conditions
However, the right of withdrawal is subject to the following conditions:
- the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
- the right does not apply to opened products if the opening compromises the integrity and/or contamination of the item;
- the right does not apply to products without the original packaging and its seals if present;
- the purchased item must be intact and returned in its original packaging, complete in all its parts.
To minimize damage to the original packaging, we recommend, where possible, placing it in a second box. Avoid applying labels or adhesive tapes directly on the original product packaging.
Attention: In case of modification compared to the standard of a product, for example, modifications through options on the size of a ring, only the amount of the product in its original state will be refunded in case of return, and not the cost of any modification.
As required by law, the shipping costs related to the return of the item are borne by the Customer.
The shipment, until the certification of receipt in our warehouse, is under the complete responsibility of the Customer; in case of damage to the item during transportation, Pois Ibiza will notify the Customer of the incident within 5 working days from receiving the item, to enable them to promptly report the incident to the courier and obtain reimbursement for the value of the item (if insured); in this case, the product will be made available to the Customer for return, simultaneously canceling the withdrawal request.
Pois Ibiza is not liable in any way for damages or theft/loss of returned goods shipped without insurance; upon arrival in the warehouse, the product will be examined to assess any damages or tampering not resulting from transportation.
Complaints
For any issues regarding delivered products (non-compliant or damaged product, missing items, etc.), please contact Pois Ibiza.
Reports of any anomalies and/or service disruptions (missing ordered merchandise, unprofessional staff, unreliable couriers, etc.) will be used to improve the service provided.
Complaints can be submitted:
a) in writing, by sending them to the address Pois Ibiza – Calle de la Cruz, 7, Ibiza, Spain
b) via email to the email address info@poisibiza.com
Attention – Please note that every complaint must be submitted complete with the contact details of the sender (name, surname, address, phone, and email) and detailed regarding the reason.
Anonymous complaints will not be considered.
Shipping
ORDER PREPARATION
Upon placing an order on this website, the time required to prepare your package and subsequently ship it depends on the availability of the products.
If, during the processing of an order, a product is no longer available due to being sold out or in production, you will receive an email informing you of the inconvenience. Your order will be updated by removing the unavailable item, and the remaining products will be shipped. The amount of the unavailable item will be automatically deducted from the total purchase amount indicated at the time of purchase, irrespective of the chosen payment method.
SHIPPING AND DELIVERY
Once the package containing all the purchased products is prepared, Pois Ibiza will proceed to ship it to you.
If you have paid by Bank Transfer, Pois Ibiza will dispatch your order only after verifying the actual crediting of the amount due. We therefore recommend that you send proof of payment via email to info@poisibiza.com to expedite checks and subsequent shipping.
Shipments are handled by express courier. Currently, only shipments within Spain are available.
Delivery typically takes 5 working days. This timeframe is independent of us, as the carrier operates independently of Pois Ibiza. However, in case of delivery delays, please notify us via email at info@poisibiza.com to promptly contact the carrier and resolve the issue. Similarly, if there are any unforeseen events during order processing (such as delays or products being out of stock), we will promptly inform you via email of the order status.
Please note that deliveries are made throughout the national territory within variable timeframes depending on the courier’s route. If you are not available at the address provided in the order, the courier is required to leave a delivery notice containing all the necessary phone numbers to arrange delivery. If no delivery notice is left, please immediately inform our Customer Service.
To avoid such unpleasant inconveniences, we recommend that you provide your telephone number in the order notes, which we will transfer to the courier solely for the purpose of finalizing the delivery.
Paymants
On this website, you can choose from various payment methods. Once you have finished shopping, a guided procedure will help you complete the purchase in just a few moments.
You can choose to pay for your orders with a credit card (Visa, Mastercard, American Express, etc.), or directly from your PayPal account, or via Bank Transfer.
1 – Credit Card Payments
Online payment by credit card (including prepaid credit card) is guaranteed by a secure connection with a highly effective data encryption system. The credit card transaction is processed through PayPal’s secure payment system. All your credit card data is handled directly by PayPal, so no one can view confidential information. PayPal automatically encrypts all information regarding the payment transaction using a 128-bit SSL (Secure Sockets Layer protocol) protocol (the highest level available for e-commerce).
N.B. You can pay with your credit card (even prepaid) through the PayPal system even if you do not have a PayPal account.
2 – PayPal Payments
If you have a PayPal account, you can proceed with payment for the order by logging into your account directly. Your account and credit card details will be managed directly by PayPal, and the funds will be transferred from your PayPal account to ours. Payment is processed immediately.
3 – Bank Transfer Payments
If you select Bank Transfer during the purchase process, you will need to make an advance Bank Transfer payable to: Pois Ibiza
including the order number in the payment reference.
Payments made in this manner typically require 2-3 working days to be credited before the actual shipment of the goods can proceed. It is recommended to send confirmation via email with the payment details and the date of the bank transfer.
Registration
Registering on this website is simple, quick, and enables you to purchase products, create your personal account, check order statuses, and receive timely email notifications of any promotions.
To register, simply follow the “My Account” link located on the homepage, or you can proceed with registration after adding products to your cart.
Upon completion of the registration form, the system will send you a confirmation email.
Browsing the e-commerce site is possible without registering.
However, registration is necessary to make a purchase.
How to buy
There are several ways to find products in the catalog. You can choose one of the categories or use the search engine, which will allow you to find results matching your needs.
PRODUCT PAGE
Once you click on a product, you will see its product page. The product page provides you with a description of the product, a detailed list of its features, and generally the technical specifications.
SHOPPING CART
Once you have found and chosen the product using the methods mentioned above, to purchase it, simply click on the ‘Add to Cart’ button. The shopping cart summarizes all the information you need in a few lines: the list of selected products, quantity, and price. Adding a product to the cart does not imply purchase. The functionalities available include Empty Cart, Update Cart, and you can also leave the purchase pending and log out by clicking on the “Exit” button. Upon subsequent access, the user will find the cart “full”, i.e., with the previous choices remembered.

CHECK PAYMENT METHODS
